Declaration on the duty to inform (privacy policy)

The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the statutory provisions (GDPR, DSG TKG 2003). In this data protection information, we inform you about the most important aspects of data processing on our website.

2) Contact with us
If you contact us using the form on the website or by e-mail, your details will be stored by us. Sending your request constitutes consent within the meaning of GDPR, Article 6, paragraph 1, letter (a).
3) rmDATA customer portal
If you register in our rmDATA customer portal, we process your personal data to fulfill the contract in connection with support requests including the implementation of pre-contractual measures (Art. 6 para. 1 lit. b GDPR) and to evaluate your inquiries for the purpose of improving our products for the duration of the upright business relationship as well as an additional period of 3 years from its termination in order to continue to contact you and inform you about our products.
You are not obliged to provide us with data; however, if you do not provide the data, we will not be able to provide the above-mentioned services.
4) Data on product use and operating errors
rmDATA only processes pseudonymized data that is used to support customer success management, rmDATA product management and to improve the quality of the solutions offered. Data is collected on the use of individual products, their modules and functions as well as data on any errors that may occur during operation. The data collected is never assigned to a specific user and is processed in aggregated form. The data is transmitted to rmDATA electronically in encrypted form; the data will not be passed on to third parties or published. The form of collection and transmission is technically necessary, as such data cannot be collected using traditional or analog tools (telephone, e-mail). Due to the aggregation and the lack of reference to specific persons, it is not possible to draw conclusions about the usage behavior of individual users from the data at any time.
By processing product usage data, rmDATA is able to understand the general user behavior of customers and users in order to make targeted improvements to products and services. This enables an increase in customer success, as rmDATA gains a comprehensive understanding of customer needs, interests and problems. In particular, rmDATA can determine which modules and functions of individual products are used most frequently and which are used less frequently. This enables rmDATA to continuously improve products and services in order to better meet the needs and requirements of customers.
Processing data on any errors that occur in the operation of products and services enables rmDATA to identify errors in its range of solutions at an early stage. Systematically occurring problems and errors can thus be identified and rectified more quickly, which leads to a significant increase in the quality of products and services for all customers. Improving the quality of the solutions offered is in rmDATA's interest, as it increases customer loyalty and raises customer satisfaction.
5) Training licenses
By submitting your application for the provision of a training license, you give your consent in accordance with GDPR, Article 6, paragraph 1, letter (a), that your application with the associated attachments and the data collected during the use of the program will be stored electronically by us.
6) Job applications
If you apply for a job offer with us, you give your consent in accordance with GDPR, Article 6, paragraph 1, letter (a), that your application documents will be stored electronically by us. All information contained in the application documents will be treated confidentially and used exclusively for the ongoing application process. If the application results in an employment relationship, the personal data will remain stored. Otherwise, your data will be deleted in a timely manner in accordance with the GDPR.
7) Marketing and public relations
We carry out marketing and public relations work to inform you and the public about our services and projects and to provide you with general information. This is based on the legitimate interest (Art. 6 para. 1 lit. f GDPR) that we present our services and inform you about them (when sending by post) and your consent (when sending information by e-mail or as a newsletter).
You have the right to object to or withdraw your consent at any time in accordance with the statutory provisions.
We store the data for a period of 3 years after the last contact.
You are not obliged to provide the data. If you do not provide the data, we will not be able to send you any information.
8) Website tracking
8.1) Cookies
Our website uses so-called cookies. These are small text files that are stored on your end device with the help of the browser. They do not cause any damage. We use cookies to make our website more user-friendly. Some cookies remain stored on your device until you delete them. They enable us to recognize your browser on your next visit. If you do not want this, you can set up your browser so that it informs you about the setting of cookies and you only allow this in individual cases. If you deactivate cookies, the functionality of our website may be limited.

8.2) Web analysis
Our website uses functions of the web analysis service Google Analytics from Google LLC (1600 Amphitheatre Parkway Mountain View, CA 94043, USA) to statistically evaluate visitor data. Cookies are used for this purpose, which enable your use of the website to be analyzed. The information generated in this way is transferred to the provider's server and stored there.
You can prevent this by setting up your browser so that no cookies are stored. We have concluded a corresponding contract with the provider for order data processing. Your IP address is recorded, but immediately pseudonymized [e.g. by deleting the last 8 bits]. This means that only a rough localization is possible.
Data processing is carried out on the basis of the legal provisions of § 96 para. 3 TKG and Art. 6 para. 1 lit a (consent) and/or f (legitimate interest) of the GDPR. Our concern within the meaning of the GDPR (legitimate interest) is the improvement of our offer and our website. As the privacy of our users is important to us, the user data is pseudonymized. The user data is stored for a period of up to 18 months.
8.3) ShareThis
Our website uses social plugins from the bookmarking service Share This Inc. ("Share This"), 4009 Miranda Avenue, Suite 200, Palo Alto, CA 94304-1227, USA. These plugins allow users to set bookmarks and post or share the corresponding content on social networks (e.g. Twitter, Facebook or Google+). If a user uses one of these functions and is also online with the corresponding service (e.g. Twitter, Facebook or Google+), the visit to our website can be assigned to the respective user there. Share This itself does not receive any personal data from us, but keeps anonymized usage statistics on the content shared. This data is deleted regularly. We have concluded a corresponding contract with the provider for commissioned data processing.
8.4) Business social media (LinkedIn & XING) and social media (Facebook, Instagram, TikTok)
We use functions of the social media network LinkedIn of LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA, on our website. When you access pages that use such functions, data (IP address, browser data, date and time, cookies) is transmitted to LinkedIn, stored and analyzed. If you have a LinkedIn account and are logged in, this data will be assigned to your personal account and the data stored in it. 8.5) LinkedIn Insight Tag
We use the LinkedIn Insight Tag for our website to measure the success of our advertising measures. No detailed information is transmitted that enables unique identification (exception: you interact with or respond to the advertisement and, for example, fill out an inquiry form). You can control the use of your personal data via the account settings in your profile.
8.6) Google Ads
We use Google Ads for our advertising measures to draw attention to our offer. Corresponding cookies allow us to measure success and, within a certain period of time, to recognize visitors who have already been to our site. We only use the data for statistical evaluations and success measurements. No detailed information is transmitted that enables clear identification.
9) Newsletter
9.1) Double opt-in
You have the option of subscribing to our newsletter via our website. To do this, we need your e-mail address and your declaration that you agree to receive the newsletter. As soon as you have registered for the newsletter, we will send you a confirmation e-mail with a link to confirm your registration.
Registration for our newsletter takes place in a so-called double opt-in procedure. This means that after registering, you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no-one can register with other people's e-mail addresses.
Subscriptions to the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address.
9.2) Cancellation of newsletter subscription
You can cancel your subscription to the newsletter at any time. Please send your cancellation to the following e-mail address: office@rmdatagroup.com You can also cancel the newsletter via an unsubscribe link in every newsletter. After receiving your cancellation of the newsletter, we will immediately delete your personal data in connection with the newsletter dispatch. This revocation does not affect the legality of the processing carried out on the basis of the consent until the revocation.
10) Use of image data (photo and video recordings at events)
At our events, photos and/or video recordings are made for the purpose of documenting and reporting on the event, in which you may be visible. The photos/video recordings are published for these purposes on LinkedIn, XING, our homepages and in the company magazine"GeoNews". For this purpose, you grant rmDATA GmbH, free of charge, the right to use the photos/video recordings in which you appear without restriction in terms of time, content and location. This also applies to repeated use.
If you do not wish to be photographed/filmed, please inform the photographer accordingly. The photographer has been instructed by us to take this into account.
The processing of your personal data, including photos and/or video recordings of events, is carried out for the purpose of public relations and presentation of the activities of rmDATA GmbH to safeguard the legitimate interests of rmDATA GmbH in accordance with Art. 6 para. 1 lit. f GDPR.
11) Your rights as a data subject
With regard to your personal data stored by us, you have the rights to information (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure to the extent permitted by law (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability with regard to the data you have provided to us (Art. 20 GDPR) and objection (Art. 21 GDPR). If you believe that the processing of your data violates data protection law or your data protection claims have otherwise been violated in any way, you can complain to us or the data protection authority.

Photo and video recordings at events
At our events, photos and/or video recordings are made for the purpose of documenting and reporting on the event, in which you may be visible. The photos/video recordings will be published for these purposes on LinkedIn, XING, our homepages and in the company magazine"GeoNews". For this purpose, you grant rmDATA GmbH, free of charge, the right to use the photos/video recordings in which you appear without restriction in terms of time, content and location. This also applies to repeated use. If you do not wish to be photographed/filmed, please inform the photographer. The photographer has been instructed by us to take this into account.
The processing of your personal data, including photos and/or video recordings, is carried out for the purpose of public relations and presentation of the activities of rmDATA GmbH (safeguarding the legitimate interests of rmDATA GmbH pursuant to Art. 6 para. 1 lit. f GDPR).
You have the right to information about your stored personal data, its origin and the purpose of data processing at any time and - where provided for by law - a right to rectification, erasure, restriction of processing, objection to processing and portability of the data you have provided.
